SUBJECT: Rescinding April 6, 2020 and July 27, 2020 Memoranda

On April 6, 2020, the U.S. Equal Employment Opportunity Commission’s Office of Federal Operations issued a memorandum about how federal sector EEO complaints covered by 29 CFR Part 1614 should be processed in light of the National Emergency declared by the President due to the coronavirus (COVID-19). OFO later adjusted the processing instructions in a July 27, 2020 memorandum.

Throughout this unprecedented time, federal EEO professionals have met the challenges posed by COVID-19, and EEOC expresses its appreciation for your dedication and effort to ensure federal employees and applicants had access to the federal sector EEO process.

Now, with the President announcing that the declaration of National Emergency has ended, OFO is giving notice that the April 6 and July 27, 2020 memoranda on processing information are now rescinded.

Each federal agency subject to the regulations at 29 CFR Part 1614 is directed to resume processing federal sector EEO complaints in accordance with 29 CFR Part 1614 regulations and EEOC’s pre-pandemic guidance and instructions.
