Bayville Fire Company Settles EEOC Age Discrimination Suit

The Bayville Fire Company on Long Island has agreed to settle a class age discrimination lawsuit brought by the U.S. Equal Employment Opportunity Commission (EEOC), the agency announced today. The fire company, as well as the Villages of Bayville, Mill Neck, and Centre Island, will pay a group of about 15-18 firefighters lost pension money and provide increased monthly pension amounts going forward to several firefighters. Depend­ing on how many class members are finally definitively identified and the exact damages established for each one, the final total damages should be $180,000 to $240,000.

Pinnacle Airlines Settles Disability Bias Suit

The U.S. Equal Employment Opportunity Commission (EEOC) today announced the settlement of a disability discrimination lawsuit against Pinnacle Airlines, Inc. for $20,000 and significant injunctive relief on behalf of a clerk with arthritis who was allegedly fired for walking too slowly on the job. Pinnacle is a Memphis, Tenn.-based airlines carrier operating out of the Detroit Metropolitan Wayne County Airport

Professional Building Systems Of North Carolina To Pay $118,000 To Settle Race Harassment Case

Professional Building Systems of North Carolina, LLC, of Mt. Gilead, N.C., will pay $118,000to six African American employees who filed charges of racial harassment with the U.S. Equal Employment Opportunity Commission (EEOC), and six more African Americans who were also subjected to racial harassment, the agency announced today. Additionally, the company agreed to significant non-monetary relief to settle the lawsuit brought by the EEOC.

Sonic Drive-In Settles EEOC Sexual Harassment Suit

A Sonic Drive-In in Grapevine, Texas, has agreed to settle a sexual harassment lawsuit filed by the U.S. Equal Employment Opportunity Commission (EEOC), for $31,000, the agency announced today. The EEOC's suit charged that SDI of Grapevine [2240 Hall Johnson Road], A Texas Partnership, subjected 17-year-old carhop Erin Schwarzbach to a sexually hostile work environment created by the general manager of the restaurant.

Jacqueline A. Berrien, the former Associate Director-Counsel of the NAACP Legal Defense and Educational Fund (LDF), was sworn in today as the Chair of the U.S. Equal Employment Opportunity Commission (EEOC)  by Acting Chairman Stuart J. Ishimaru. She becomes the fourteenth Chair of the EEOC, which will celebrate the 45th anniversary of its founding in July.

Tyson Foods Sued by EEOC for Disability Bias

The U.S. Equal Employment Opportunity Commission (EEOC) today announced that it has filed a disability discrimination lawsuit against global meat processor Tyson Foods, Inc.  The suit alleges that Tyson refused to rehire an employee at its Sedalia, Mo., location for a full-time position in the maintenance department because of his epilepsy.

Gonnella Baking Co., a Chicago-area baking company, will pay $350,000 to settle a national origin harassment and retaliation suit filed by the U.S. Equal Employment Oppor­tunity Commission (EEOC), the agency announced today. The company will also be subject to a four-year consent decree, under which it will be required to report any further complaints of discrimination or retaliation to the EEOC and to provide training about employment discrimination law to its managers and other employees.

EEOC Sues Lowe's Home Centers For Religious Discrimination

Lowe's Home Centers committed religious discrimination by requiring an employee to work on his Sabbath, and by harassing and retaliating against the employee, causing him to lose hours, the U.S. Equal Employment Opportunity Commission (EEOC) charged in a lawsuit it filed yesterday. The EEOC also pointed out that while Lowe's has an asserted policy for requesting religious accommodations, its workplace policy and practice was to refuse to accommodate sincerely held religious beliefs of its employees, in violation of federal law.

Greenforest-McCalep Christian Academic Center, a subsidiary of Greenforest Community Baptist Church, will pay $53,000 and furnish other relief to settle two pregnancy discrimination lawsuits brought by the U.S. Equal Employment Opportunity Commission (EEOC), the agency announced today.  The agency had charged that the Decatur, Ga., Christian school violated federal law when it fired one employee and rescinded a job offer to an applicant after it became aware they were pregnant.

Federal Court Enters $50,000 Consent Decree Ending EEOC Suit Against Abbotsford Egg Processor

U.S. Magistrate Judge Stephen L. Crocker of the federal district court in Madison yesterday entered a consent decree resolving a lawsuit brought by the U.S. Equal Employment Opportunity Commission against Mr. B's of Abbotsford, Inc., formerly known as Abbotsford Egg Products.  The EEOC had charged that the Abbotsford, Wis., former egg processing company unlawfully fired a production employee, Nicki Heberle, because of her epilepsy, despite Heberle's ability to perform the essential functions of her job.
