EEOC Wins Rare Partial Summary Judgment Ruling in Racial Harassment Case

A federal judge has granted partial summary judgment in favor of the U.S. Equal Employment Opportunity Commission (EEOC) and denied an employer's motion for sanctions in an EEOC class racial harassment case against a Utah construction company, the federal agency announced today.  In so doing, the judge found that three black employees were subjected to an objectively hostile work environment and that the employer may not assert an affirmative defense to liability.  United States District Judge Dale A. Kimball also denied the employer's motion for sanctions, characterizing it as "wholly without merit."

Court Orders AA Foundries to Take Extensive Measures to Prevent Racial Harassment

A federal judge has ordered AA Foundries, Inc., a local San Antonio manufacturer of ferrous castings and producer of foundry mold machines, to implement extensive measures to prevent racial harassment, the U.S. Equal Employment Opportunity Commission (EEOC) announced today.  The EEOC had charged in the underlying lawsuit that African-American employees at AA Foundries routinely experienced racially offensive treatment.  The order follows a jury award of $200,000 in punitive damages to three former employees of AA Foundries.

EEOC Sues Baby O's Restaurant of Jackson for Race Discrimination and Retaliation

Baby O's Restaurant, Inc., a Mississippi corporation doing business in Jackson, Miss., as Danny's Cabaret , a "gentlemen's club" featuring "adult entertainment," violated federal law by subjecting four black female entertainers to discrimination because of their race, the U.S. Equal Employment Opportunity Commission (EEOC) charged in a lawsuit filed on Sept. 28.   The EEOC also alleged the restaurant retaliated against the discrimination victims after one filed a charge of discrimination.

Hampton Inn Franchise to Pay $85K to Settle EEOC Race and National Origin Bias Suit

A Hampton Inn franchise in Craig, Colo., owned and operated by Century Shree Corporation, will pay $85,000 and furnish other relief to settle a race and national origin discrimination suit filed by the U.S. Equal Employment Opportunity Commission (EEOC), the agency announced today.  The EEOC charged that the company illegally terminated employees beginning in August 2009 because of their race, Caucasian, and national origin, non-Hispanic.

Performance Drilling to Pay $28,000 to Settle Race Discrimination Lawsuit with EEOC

The U.S. Equal Employment Opportunity Commission announced today that it settled, for $28,000 and other relief, a race discrimination lawsuit against Performance Drilling Company LLC. Brandon, Miss.-based Performance Drilling provides land drilling services for natural gas and oil exploration and production companies in Mississippi, Alabama, Arkansas, Louisiana, Florida and East Texas. Prior to settlement, Performance Drilling filed for Chapter 11 bankruptcy.

EEOC Sues Dollar General for Race Discrimination and Retaliation

The U.S. Equal Employment Opportunity (EEOC) announced today that it has filed a lawsuit for race discrimination and retaliation against Dollar General Corporation, asserting that it violated federal law when it denied a black lead sales associate in a Long Beach, Miss., store a promotion to a vacant assistant store manager position because of her race. The EEOC said the store also retaliated against her for complaining, and filing a charge of discrimination with the EEOC.

Schindler Elevator Corporation, one of the leading global manufacturers, installers, and servicers of elevators, escalators and moving walkways, discriminated against a black elevator mechanic when it fired him because of his race, the U.S. Equal Employment Opportunity Commission (EEOC) charged in a lawsuit it filed today.  The company maintains it headquarters in Morristown, N.J.

The MBM Corporation's food distribution facility in Mason City, Iowa, one of many operated by the company, violated the law when company officials failed to remove racist graffiti from the men's room even after receiving a complaint, the U.S. Equal Employment Opportunity Commission (EEOC) charged in a lawsuit it filed in federal court on Sept. 25. Sandia Drilling Company, Ltd, L.L.P. and Sandia Drilling of Texas, L.L.C., Bossier City, La., oil drilling companies, violated federal anti-discrimination laws when their supervisors and other employees subjected two African-American and a Hispanic worker to a racially hostile work environment, the U.S. Equal Employment Opportunity Commission (EEOC) charged in a lawsuit it filed today.  The companies also fired one discrimination victim in retaliation for complaining, the agency said.

Charlotte-based Bojangles' Restaurants, Inc. has agreed to pay $33,426 and provide substantial additional relief to settle a sexual harassment and retaliation lawsuit filed by the U.S. Equal Employment Opportunity Commission (EEOC), the agency announced today.  The EEOC had charged that an employee at a Greensboro Bojangles' was sexually harassed and then fired for complaining about it.

The U.S. Equal Employment Opportunity Commission (EEOC) has released for public comment a draft of its Strategic Enforcement Plan (SEP).  Comments must be submitted by 5:00 pm ET on September 18, 2012 at strategic.plan@eeoc.gov or received by mail at Executive Officer, Office of the Executive Secretariat, U.S. Equal Employment Opportunity Commission, 131 M Street, NE, Washington, D.C. 20507.  The Commission plans to vote on the draft plan at the end of this fiscal year.
