Windmill Farms Nurseries to Pay $40,000 to Settle EEOC Sexual Harassment Lawsuit and Retaliation

Windmill Farms Nurseries, Inc., a plant material wholesaler and nursery located in Zolfo Springs, Fla., will pay $40,000 and furnish other relief to settle a sexual harass­ment lawsuit filed by the U.S. Equal Employment Opportunity Commission (EEOC), the agency announced today. The EEOC charged the company with subjecting a female employee, Sheila Aguilar, to sexual harassment and retaliation by her immediate supervisor, crew leader Alvaro DeSantiago.

EEOC Sues S&B Industry for Disability Discrimination

S&B Industry, Inc., a Fort Worth cellphone repair facility, violated federal law by denying employment to two hearing-impaired applicants because of their disability, the U.S. Equal Employ­ment Opportunity Commission charged in a lawsuit it filed today.  The EEOC's suit also alleged that S&B Industry violated the law by denying the two applicants a reasonable accommodation during the application process.

Disability Services Company Sued by EEOC for Discriminating Against Disabled Employees

ValleyLife, a disability support services company, unlawfully discriminated against disabled employees by refusing to provide them with reasonable accommodations in violation of federal law, the U.S. Equal Employment Opportunity Commission (EEOC) charged in a lawsuit filed today in the United States District Court for the District of Arizona.  ValleyLife is an Arizona corporation which provides programs and support services for individuals with disabilities in the greater Phoenix metropolitan area.

Wal-Mart to Pay $150,000 to Settle EEOC  Age and Disability Discrimination Suit

Wal-Mart Stores of Texas, L.L.C. (Wal-Mart) has agreed to pay $150,000 and provide other significant relief to settle an age and disability discrimination lawsuit brought by the U.S. Equal Employment Opportunity Commission (EEOC), the agency announced today.  The EEOC charged in its suit that Wal-Mart discriminated against the manager of the Keller, Texas Walmart store by subjecting him to harassment, discriminatory treatment, and discharge because of his age.  The EEOC also charged that Wal-Mart refused to provide a reasonable accommodation for the man's  disability as federal law requires.

Benny Boyd Car Dealership to Pay $250,000 to Former Manager in EEOC Settlement

Benny Boyd Chevrolet-Chrysler-Dodge-Jeep, Ltd., d/b/a Benny Boyd Lubbock, and Boyd-Lamesa Management, L.C. will pay $250,000 in damages and back pay to former manager Randall Hurst to settle a federal disability discrimination suit, the U.S. Equal Employment Opportunity Commission (EEOC) announced today.  The EEOC had charged the automobile dealership with disability discrimination law by denying a partnership to Hurst because of his multiple sclerosis, subjecting him to a hostile work environment and forcing him to quit as a result.

Shipley's Do-Nuts Franchise Sued by EEOC for Pregnancy Discrimination and Retaliation

D & S Shipley Donuts d/b/a Shipley's Do-Nuts, a Katy-area franchise of Shipley's Do-Nuts, violated federal anti-discrimination laws when it forced an employee whom it suspected of being pregnant, to take unpaid leave until she was cleared by a doctor indicating that she could work despite her pregnancy, the U.S. Equal Employment Opportunity Commission (EEOC) charged in a lawsuit filed today. When the employee failed to provide a release, and after she and her mother disputed the legality of the requirement, the employee was fired in retaliation.

Appellate Court Overturns $4 Million Fee Award Against EEOC

The U.S. Court of Appeals for the Eighth Circuit issued an order Monday reversing a federal district court's decision granting over $4 million in fees and costs to CRST Van Expedited Inc. (CRST), a trucking company, against the U.S. Equal Employment Opportunity Commission (EEOC), and remanding the case back to the lower court to "individually assess each of the claims" and "explain why it deems a particular claim to be frivolous, unreasonable, or groundless."
