Mach Mining and Affiliated Companies to Pay  $4.25 Million to Settle EEOC Sex Discrimination Suits

The U.S. Equal Employment Opportunity (EEOC) announced today that it has resolved two lawsuits against a group of affiliated coal mining companies that it had accused of hiring practices that effectively excluded women from working in the underground mines and in other coal production positions. The cases were resolved by a single consent decree entered by Senior District Judge J. Phil Gilbert. The decree calls for the mining companies to jointly pay a total of $4.25 million to a group of women applicants who were denied jobs because of sex discrimination. Additionally, the companies have agreed to hiring goals that are expected to result in at least 34 women being hired into coal production jobs in their mines that operate in Illinois.

President Appoints Victoria A. Lipnic  EEOC Acting Chair

The U.S. Equal Employment Opportunity Commission (EEOC) today announced that President Trump has named Commissioner Victoria A. Lipnic Acting Chair of EEOC.  Lipnic has served as an EEOC Commissioner since 2010, having been nominated to serve by President Barack Obama, and confirmed by the Senate, initially for a term ending on July 1, 2015. President Obama nominated her to serve a second term ending on July 1, 2020, and she was confirmed by the Senate on November 19, 2015.

Scottsdale Wine Café, LLC (5th & Wine), a Scottsdale wine bar and restaurant, violated federal law by subjecting two of its male employees to a hostile work environment based on sexual orientation and by retaliating against one employee, the U.S. Equal Employment Opportunity Commission (EEOC) charged in a lawsuit filed on Friday, January 20, 2017.

EEOC Issues Quality Practices Plan on Federal Sector Hearings, Appeals and Oversight Functions

The U.S. Equal Employment Opportunity Commission (EEOC) today published Federal Sector Quality Practices (FSQP) to address the quality of the agency's hearings and appeals in federal employee employment discrimination complaints. The FSQP also devotes attention to the Commission's role in providing oversight of federal agencies when reviewing affirmative employment and barrier analysis plans, evaluating federal agency complaint processes, and offering technical assistance to federal agencies. It is modeled on the private sector's Quality Practices for Effective Investigations and Conciliations (QEP), created pursuant to EEOC's Strategic Enforcement Plan.

EEOC Issues Regulations on the Federal Government's Obligation to Engage in Affirmative Action for People with Disabilities

The U.S. Equal Employment Opportunity Commission (EEOC) today published regulations explaining what federal agencies must do to comply with their legal obligation to engage in affirmative action in employment and otherwise serve as "model employers" for individuals with disabilities. The regulations do not impose any obligations on private businesses or state and local governments. EEOC has also published a question-and-answer document on the regulations.

SAN DIEGO - A federal judge has ordered Mexicali Chicken & Salads, an El Centro, Calif.-based restaurant, to pay $27,692 to resolve a discrimination lawsuit filed by the U.S. Equal Employment Opportunity Commission (EEOC) on behalf of a female employee who was sexually harassed by her manager and then fired when she complained, the federal agency announced today.

Saint Vincent Health Center To Pay $300,000 To Settle EEOC Religious Accommodation Lawsuit

Saint Vincent Health Center will pay $300,000 constituting back pay and compensatory damages to a class of six aggrieved former employees and provide substantial injunctive relief to settle a religious discrimination lawsuit brought by the U.S. Equal Employment Opportunity Commission (EEOC), the federal agency announced.  Senior U.S. District Judge Barbara J. Rothstein entered a consent decree on December 23, 2016. EEOC filed the lawsuit, U.S. EEOC v. Saint Vincent Health Center, Civil Action No. 1:16-cv-234, on Sept. 22, 2016, in U.S. District Court for the Western District of Pennsylvania, Erie Division.
