Section I:  FOIA Leadership and Applying the Presumption of Openness

A. Leadership Support for FOIA

  1. The FOIA requires each agency to designate a Chief FOIA Officer who is a senior official at the Assistant Secretary or equivalent level. See 5 U.S.C. § 552(j)(1) (2018).  Is your agency’s Chief FOIA Officer at this level?

    The Chief FOIA Officer and/or the Assistant Legal Counsel for the FOIA Division conducted training for the EEOC’s Chair, Commissioners, or their staff.  The Assistant Legal Counsel for the FOIA Division provided training for other non-FOIA staff upon request.

The Attorney General’s 2022 FOIA Guidelines provides that “agencies should confirm in response letters to FOIA requesters that they have considered the foreseeable harm standard when reviewing records and applying FOIA exemptions.” Does your agency provide such confirmation in its response letters?

B. Presumption of Openness

Section II:  Fair and Effective FOIA Administration

A. FOIA Training

  1.  The FOIA directs agency Chief FOIA Officers to ensure that FOIA training is offered to agency personnel. See 5 U.S.C. 552(a)(j)(2)(F). Please describe the efforts your agency has undertaken to ensure proper FOIA training is made available and used by agency personnel.

    See response to question I.A.3. supra. In addition, FOIA professionals were provided with an annual Training in March 2024. Also, many FOIA professionals take some, most, or all the virtual trainings provided by DOJ OIP.

    The Commissions FOIA Division provides annual FOIA training in a virtual environment to all FOIA processors on an annual basis usually in the month of March or April. This is a two-day training approximately four hours each day. FOIA Division staff also provide high-level FOIA training to senior leaders and other internal stakeholders upon request.
     

B. Outreach

  1. As part of the standard request process, do your FOIA professionals proactively contact requesters concerning complex or voluminous requests in an effort to clarify or narrow the scope of the request so requesters can receive responses more quickly? Please describe any such outreach or dialogue and, if applicable, any specific examples.

    Yes.  Very frequently, FOIA Division Headquarters staff, including Government Information Specialists and Attorney Advisors, negotiate with requesters over the phone concerning the temporal scope of the request, the precise search terms to be used when conducting an email or other electronic document search and identifying particular custodians likely to have records potentially responsive to the request.
     
  2. Outside of the standard request process or routine FOIA Liaison or FOIA Requester Service Center interactions, did your FOIA professionals engage in any outreach or dialogue, with the requester community or open government groups regarding your administration of the FOIA? For example, did you proactively contact frequent requesters, host FOIA-related conference calls with open government groups, or provide FOIA training to members of the public? Please describe any such outreach or dialogue and, if applicable, any specific examples of how this dialogue has led to improvements in your agency’s FOIA administration.

    The Assistant Legal Counsel for the FOIA Division, who is also the Commission’s FOIA Public Liaison, is a board member of the American Society of Access Professionals (ASAP) whose mission is to foster awareness and provide training to both the requester community and federal FOIA staff.
     
  3. The FOIA Improvement Act of 2016 requires additional notification to requesters about the services provided by the agency’s FOIA Public Liaison. Please provide an estimate of the number of times requesters sought assistance from your agency’s FOIA Public Liaison during FY 2024 (please provide a total number or an estimate of the number for the agency overall). 

    EEOC estimates that the FOIA Public Liaison responded to a minimum of 308 requests for assistance. Additional support to the requester community was provided via the FOIA Requester Service Center (FRSC) line at least 176 times.
     

C. Other Initiatives

  1. Has your agency evaluated the allocation of agency personnel resources needed to respond to current and anticipated FOIA demands? If so, please describe what changes your agency has or will implement.

    Yes. The EEOC FOIA Division has instituted, and periodically reassesses, best practices used to ensure that the FOIA systems operates efficiently and effectively.  Inventories among Government Information Specialists are monitored on a weekly basis and requests transferred between staff as necessary to increase the agency’s timely completion of FOIA requests.  Another important step is fully staffing the FOIA components, which we hope to maintain moving forward.
     
  2. How does your agency use data or processing metrics to ensure efficient management of your FOIA workload? For example, case management reports, staff processing statistics, etc. In addition, please specifically highlight any data analysis methods or technologies used.

    EEOC’s FOIA Processing software provides the ability to run reports on a variety of metrics.  Reports are generated regularly concerning staff workload, number of requests received, closed, pending, and overdue which are made available to District Directors and the Chief FOIA Officer and other EEOC staff upon request.  Regular meetings are held with the FOIA Division, Chief FOIA Officer, and field office liaisons to review information in the reports and make adjustments to FOIA processing, request allocation, and procedures as necessary. This data also is used in regular collaborations with OIT staff to identify technology issues, to and develop and monitor necessary updates for the electronic FOIA system used at EEOC.   
     
  3. The federal FOIA Advisory Committee, comprised of agency representatives and members of the public, was created to foster dialogue between agencies and the requester community, solicit public comments, and develop recommendations for improving FOIA administration. Since 2020, the FOIA Advisory Committee has issued a number of recommendations. Please answer the below questions:
     
    1. Is your agency familiar with the FOIA Advisory Committee and its recommendations?

      Yes. The Assistant Legal Counsel for the FOIA Division was a member of the FOIA Advisory Committee during its 2022 – 2024 term.
       
    2. Has your agency implemented any of its recommendations or found them to be helpful? If so, which ones?

      Yes.
  • Recommendation 2022-10 (“Agencies should endeavor to provide regular and proactive online publication of searchable FOIA logs in … Excel/CSV … format.”) has been implemented. The Commission publishes its FOIA log once a year on its public-facing website.
     
  • Recommendation 2023-01 (“… OIP should issue guidance stating that when agencies use FOIA Exemption 5 to withhold information they should identify the corresponding privilege(s) invoked (e.g., deliberative process, attorney-client, etc.) in redaction labels and, if the record is withheld in full, in its determination letter.”) has been implemented. When Exemption 5 is used for more than one category in a set of releasable records, the Commission identifies one or more of those categories at the point of redaction if space permits. It also identifies the various categories in its determination letter to the requester.
     
  • Recommendation 2024-01 (“… OIP should publish the Committee’s draft model determination letter as a best practices reference for agencies.”). EEOC’s Assistant Legal Counsel for the FOIA Division has reviewed the model determination letter.
     
  • Recommendation 2024-02 (“… OIP should issue guidance encouraging agencies to proactively offer requesters the opportunity to discuss their request with an agency representative.”) has been implemented. It is routine practice for Commission FOIA staff to reach out to requesters proactively to discuss their request.

Section III: Proactive Disclosures

A. Posting Material

  1. Please describe what steps your agency takes to identify, track, and post (a)(2) proactive disclosures.

    In FY 24, as in previous years, over 90% of FOIA requests the Commission receives are for private-sector charge files. Due to the confidentiality provisions of Title VII §§ 706(b) and 709(e) the Commission “shall not make public charges which have been filed.” 29 C.F.R. §§ 1610.17(e), (f). Section 107 of the Americans with Disabilities Act (ADA), section 207(a) of the Genetic Information Nondiscrimination Act (GINA), and section 104 of the Pregnant Workers Fairness Act (PWFA) explicitly adopt Title VII’s disclosure prohibition. 29 C.F.R. § 1610.17(i). Additionally, charges under the other two statutes that EEOC enforces, the Equal Pay Act and Age Discrimination in Employment Act (ADEA), are investigatory records subject to confidentiality because they are compiled for law enforcement purposes  29 C.F.R. 1610.17(j)  Because of these prohibitions, the Commission cannot post materials requested in the vast majority of its FOIA requests.

Section IV: Steps Taken to Greater Utilize Technology

For example, does your agency use machine learning, predictive coding, technology assisted review or similar tools to conduct searches or make redactions? If so, please describe and, if possible, estimate how much time and financial resources are saved since implementing the technology.

    Yes. The EEOC uses Relativity to conduct searches of email and other voluminous data sets using keywords/search terms. This process allows FOIA staff to conduct the searches without interrupting or disturbing the work of non-FOIA staff.  We believe this saves significant time and resources for program staff who otherwise would need to stop their work to perform these searches, although we have not performed any formal accounting of those savings.
     
  4. OIP issued guidance in 2017 encouraging agencies to regularly review their FOIA websites to ensure that they contain essential resources and are informative and user-friendly. Has your agency reviewed its FOIA website(s) during the reporting period to ensure it addresses the elements noted in the guidance?

    Yes.
     
  5. Did all four of your agency's quarterly reports for Fiscal Year 2024 appear on your agency's website and on FOIA.gov?

    Commission FOIA staff continue reviewing the records associated with these requests. However, they are voluminous and will require many more months to fully process. Interim productions have been made to the requester when possible.

    Yes. There were three.

    FOIA litigation document productions are processed by OLC’s FOIA Attorney advisors. Those same attorneys – only three total – also process FOIA requests as well as FOIA appeals arising from charge file FOIA requests processed by OFP. Thus, the litigation is limiting the bandwidth these FOIA attorney advisors can devote to their other duties.
