EEOC Issues Final Rule Revising Federal Sector Equal Employment Opportunity Complaint Process

The U.S. Equal Employment Opportunity Commission (EEOC) today issued a final rule modifying certain aspects of the complaint process that is used by federal employees and applicants who believe they have been subjected to prohibited employment discrimination by federal agencies. The final rule was coordinated with other federal agencies and reviewed by the U.S. Office of Management and Budget. The rule was posted for public inspection today and will be published in the Federal Register on Wednesday, July 25, 2012.

A federal jury has awarded $350,000 in compensatory and punitive damages to three former employees Endoscopic Microsurgery Associates, a Baltimore-area medical practice, who were subjected to unwanted sexual advances by the chief executive officer and the chief financial officer, the U.S. Equal Employment Opportunity Commission (EEOC) announced today.

Howard University Failed to Hire Applicant Due to His Disability, EEOC Says

Howard University in the District of Columbia violated federal law when it refused to hire an applicant for a security position at its hospital because of his disability, diabetes, the U.S. Equal Employment Opportunity Commission (EEOC) charged in a lawsuit it filed today.  Howard University, founded in 1862, is a private, historically black university.  Howard University Hospital is a division of the University at large and is subject to its employment policies and procedures.

Court Orders Hawaii HealthCare Professionals and Its Owner to Pay over $190,000 for Age Discrimination

Hawaii Healthcare Professionals, Inc. – also known as Hawaii Professional HomeCare Services, Inc. – and its owner have been ordered to pay $193,236 to a woman allegedly fired due to her age, in a default judgment awarded by U.S. District Judge Alan C. Kay in Hawaii, the U.S. Equal Employment Opportunity Commission (EEOC) announced today.  The judgment resolves an age discrimination lawsuit filed by the EEOC against the Honolulu-based home health care services company in 2010.

West Texas Oil Field Service Company Settles EEOC National Origin Harassment Suit Mid-Trial

Midland, Texas-based Blue Ridge Resources, L.L.C. has settled a national origin harassment lawsuit brought by the U.S. Equal Employment Opportunity Commission (EEOC) on the second day of trial, before the case was submitted to the jury, the federal agency announced today. The settle­ment pays three former oil field service crew members $43,000 in damages for the mistreat­ment and provides extensive injunctive relief to prevent future unlawful conduct.

EEOC and Family Dollar Stores Sign Mediation Pact

The U.S. Equal Employment Opportunity Commission (EEOC) and Family Dollar Stores, Inc. (NYSE:FDO) today announced the signing of a National Universal Agreement to Mediate (NUAM) to informally resolve workplace disputes through Alternative Dispute Resolution (ADR) prior to an EEOC investigation or potential litigation. The NUAM applies to all Family Dollar establishments throughout the United States.

Next Commission Meeting Wednesday, July 18

Federal Court Hammers Fry's Electronics for Discovery Abuses in EEOC Harassment Suit

A federal judge ordered sanctions on July 3, 2012, including a $100,000 penalty, against Fry's Electronics, Inc., due to its actions in a sexual harassment and retaliation lawsuit brought by the U.S. Equal Employment Opportunity Commission (EEOC), the agency announced.   The penalized behavior includes intentionally withholding evidence, raising a "fallacious" argument and demonstrating a "disturbing lack of candor to the tribunal."  According to U.S. District Court Judge Robert S. Lasnik, "The Court finds that defendant's conduct in this respect was unfair, unwarranted, unprincipled, and unacceptable."

Giumarra Vineyards, one of the largest growers of table grapes in the United States, will settle a sexual harassment and retaliation lawsuit filed by the U.S. Equal Employment Opportunity Commission (EEOC), the federal agency announced today.  The company agreed to comprehensive and sweeping changes of company procedures in dealing with discrimination and retaliation, affecting up to 3,000 employees and to expend a total of $350,000 to resolve EEOC's case.
