Major Washington Apple Grower Sued for Sexual Harassment

One of the largest apple producers in the United States has been placed under a temporary restraining order (TRO) filed by the U.S. Equal Employment Opportunity Commission (EEOC), the agency announced today. The federal agency was motivated by the immediate danger of "substantial and irreparable injury" to class members and potential witnesses in the EEOC's sexual harassment suit against Cowiche, Wash.-based Evans Fruit Company, which was filed at the same time as the agency's TRO request.

EEOC Lawsuit Challenges Sexual Harassment and Retaliation at North Dakota Applebee's

The Applebee's Neighborhood Grill & Bar – Bismarck South, owned and operated by Apple Core, Inc. and Food Management Investors, Inc. (FMI), violated federal civil rights laws by permitting a former store general manager to create a pattern and practice of sexual harassment and retaliation against employees, the U.S. Equal Employment Opportunity Commission (EEOC) charged in a lawsuit filed late yesterday.

Federal Court Enters Consent Decree Resolving EEOC Sex Harassment Suit Against Biewer Sawmill

Judge William M. Conley of the federal district court in Madison has entered a consent decree resolving a lawsuit brought by the U.S. Equal Employment Opportunity Commission against Biewer Wisconsin Sawmill, Inc. (BWS) of Prentice, Wis. The EEOC had charged that BWS, a major Midwestern lumber supplier, violated Title VII of the Civil Rights Act of 1964 when it did not take immediate and appropriate action to stop a supervisor's sexual harassment after learning that he had repeatedly exposed his genitals to female employees over several years.

Two Sonic Franchises Sued By EEOC For Sexual Harassment To Pay $55,000

Two Sonic Drive-In franchises in the Kingwood-Humble area with common ownership and management will pay $55,000 to settle a sexual harassment lawsuit filed by the U.S. Equal Employment Opportunity Commission (EEOC), the agency announced today. The EEOC had charged that S.D.I. of Kingwood, doing business as the Kingwood Sonic Drive-In, and S.D.I. of Lee Rd., doing business as the Lee Road Sonic Drive-In, violated federal law by routinely subjecting teenaged female employees to abuse by a manager and others, including threatening one young worker with a knife.

Four Points By Sheraton Sued By EEOC For National Origin Discrimination

The U.S. Equal Employment Opportunity Commission today announced that it has filed a lawsuit in federal court accusing hotel company TOG, which owns the Four Points by Sheraton in Phoenix, of discriminating against an employee by subjecting him to a hostile work environment because of his Iraqi national origin. The EEOC also charged that by allowing the continued and escalating workplace harassment, the defendants forced the employee to resign.

Temp Agency ADECCO USA Settles EEOC Sexual Harassment and Retaliation Lawsuit

Adecco USA, a Global Fortune 500 staffing company, will pay $12,000 and provide equitable relief to settle a sexual harassment and retaliation lawsuit brought by the U.S. Equal Employment Opportunity Commission (EEOC), the agency announced today.  In addition to this settlement, recently the EEOC won $79,500 from the plastics company where the discrimination victims were sent by Adecco to work, for a total of $91,500 in damages for the victims in this case.

National Denture Provider to Pay $150,000 to Settle EEOC Sex and Race Harassment Suit

Affordable Care, Inc., a national denture provider, will pay $150,000 and furnish other relief to settle a sex and race discrimination lawsuit filed by the U.S. Equal Employment Opportunity Commission (EEOC), the agency announced today.  The lawsuit, filed in March 2009 in federal court in Springfield, Mass., charged that Affordable Care violated federal law when its affiliated dentist, Nelson Wood, sexually and racially harassed two female employees.

EEOC Obtains $50,000 from Texas Transportation Brokerage Companies for Retaliation

Two Dallas/Fort Worth-area transportation brokerage companies will pay $50,000 and provide additional remedial relief to settle a discrimination lawsuit filed by the U.S. Equal Employment Opportunity Commission (EEOC), the agency announced today.  The EEOC had charged that Joshua Male's employer unlawfully retaliated against him by firing him because he had complained about workplace comments being made by two coworkers at the Sugar Land, Texas facility where they worked.

EEOC Collects on $471,000 Jury Award after Winning Appeal from Waterproofing Company  In Sex Harassment Case

The Equal Employment Opportunity Commission (EEOC) announced today that Everdry Marketing and Management has paid $471,096 in damages, plus $86,581 in post-judgment interest, to 13 victims of sexual harassment.  The payout satisfies a judgment obtained by EEOC against Everdry in October 2006 following a four-week trial in Rochester, N.Y. (case # 01-CV-6329).  The individual payouts range from about $24,000 to $56,000, including the interest, which covers the time the women had to wait to receive their jury awards.  Everdry was required to pay the substantial interest after the ultimate resolution of the case was delayed by an appeal Everdry filed in the U.S. Court of Appeals for the Second Circuit challenging various aspects of the jury's verdict and other district court rulings.  The Court of Appeals affirmed the jury's verdict and award of damages.

Alabama KFC Owner to Pay More than $1 Million to Settle EEOC Sexual Harassment Suit

The U.S. Equal Employment Opportunity Commission (EEOC) announced today that Jack Marshall Foods, Inc., doing business as Kentucky Fried Chicken, Inc., a Tuscaloosa, Ala.-based company, will pay a group of about 19 female employees, including at least three who were teenagers at the time they were employed there, $1,052,000 and furnish significant remedial relief to settle a lawsuit brought by the federal agency charging sexual harassment.

Sonic Drive-In Settles EEOC Sexual Harassment Suit

A Sonic Drive-In in Grapevine, Texas, has agreed to settle a sexual harassment lawsuit filed by the U.S. Equal Employment Opportunity Commission (EEOC), for $31,000, the agency announced today. The EEOC's suit charged that SDI of Grapevine [2240 Hall Johnson Road], A Texas Partnership, subjected 17-year-old carhop Erin Schwarzbach to a sexually hostile work environment created by the general manager of the restaurant.

P. David Lopez Sworn in as General Counsel of the EEOC

David Lopez, a 15-year agency veteran, was sworn in today as General Counsel of the U.S. Equal Employment Opportunity Commission (EEOC), in a ceremony at the agency's Phoenix District Office.  He becomes the first General Counsel to be appointed from the ranks of field attorneys.

The U.S. Equal Employment Opportunity Commission (EEOC) filed suit today against RJB Properties, Inc. and Blackstone Consulting, Inc., charging that the companies discriminated against Hispanic employees because of their national origin, sexually harassed a male employee, and retaliated against employees who objected to the discrimination against Latino employees.

Court Orders Frozen Food Giant Schwan's To Comply with EEOC Subpoena in Sex Bias Case

In a ruling issued late on March 8, 2010, Magistrate Judge Janie S. Mayeron of U.S. District Court for the District of Minnesota ordered the Minnesota-based frozen food delivery company Schwan's Home Service to comply with a federal government subpoena by March 29, 2010.  The subpoena, issued by the U.S. Equal Employment Opportunity Commission (EEOC) pursuant to an investigation of a charge of sex discrimination filed by former Schwan's employee Kim Milliren, seeks personnel information about persons employed as general managers at Schwan's facilities nationwide from January 1, 2006 to the present.
