Banner Health Settles EEOC Disability Discrimination Lawsuit for $255,000

The U.S. Equal Employment Opportunity Commission (EEOC) announced today that it has settled a disability discrimination lawsuit against Banner Health, headquartered in Phoenix. The EEOC had charged the company with breaching a mediation agreement it entered into, and firing and failing to accommodate an employee because he had a disability. Banner Health operates in Colorado, Nebraska, Arizona, California, Nevada, Wyoming, and Alaska. It is one of the largest non-profit health care systems in the country.

Unlawful Discrimination Based on Pregnancy and Caregiving Responsibilities Widespread Problem, Panelists Tell EEOC

At a time when most pregnant women want and need to work, and more American workers struggle to balance work and family, discrimination against pregnant women and workers with caregiving responsibilities remains a significant problem, experts told the U.S. Equal Employment Opportunity Commission at a public meeting today.  The meeting follows up on Commission meetings in 2007, when the Commission issued its groundbreaking "Enforcement Guidance on Unlawful Disparate Treatment of Workers with Caregiving Responsibilities" and in 2009 when the Commission issued "Employer Best Practices for Workers with Caregiving Responsibilities."

EEOC Wins Jury Award from Phoenix Subway Franchisee for Pregnancy Discrimination

In a legal victory for the U.S. Equal Employment Opportunity Commission (EEOC), an Arizona federal jury returned a verdict for punitive damages against High Speed Enterprise, Inc., a corporation that owns five Phoenix-area Subway fast-food restaurant franchises. Federal District Court Judge Roslyn O. Silver had previously ruled that a central Phoenix Subway violated federal law when it refused to hire a job applicant solely because she was pregnant. Thursday, January 26, 2012, the Phoenix jury of seven -- five men and two women -- returned a unanimous verdict finding that Belinda Murillo, the job applicant, was entitled to punitive damages. The jury awarded $7,280 in punitive damages to Belinda Murillo. The court will now decide back pay damages and injunctive relief.
