EEOC Releases Performance and Accountability Report Under New Strategic Plan

The U.S. Equal Employment Opportunity Commission (EEOC) finished fiscal year 2012 with record high monetary recoveries for victims of discrimination, as well as a significant decrease in its inventory of pending cases, the agency announced in its Performance and Accountability Report  (PAR) released Nov. 16.  This is the first performance report compiled under the standards of the EEOC's new Strategic Plan adopted on February 22, 2012, after comprehensive review and significant public input.  The new plan took effect in March, 2012.

EEOC's Denver Office Enters into Memorandum of Understanding with Mexican Consulate

The Denver Field Office of the U.S. Equal Employment Opportunity Commission (EEOC) entered into a Memorandum of Understanding with the Consulate of Mexico in Denver today.  The agreement establishes an ongoing collaborative relationship between these two entities to provide Mexican nationals with information, guidance, and access to resources on the prevention of discrimination in the workplace, regardless of documentation status.  Mexican Consul General Andrés Chao and Rayford O. Irvin, director of the EEOC's Phoenix District Office, signed the agreement.

A North Carolina corporation that manufactures, designs, and produces orthopedic and sports medicine products will pay $55,000 and furnish further relief to settle a religious discrimination lawsuit brought by the U.S. Equal Employment Opportunity Commission (EEOC), the agency announced today.

Sixth Circuit Overturns Award of Attorney Fees Against EEOC

The U.S. Equal Employment Opportunity Commission (EEOC) should not have been ordered to pay $2.6 million in attorney fees and was wrongly denied permission to litigate a lawsuit alleging sex discrimination against a class of women in Michigan, the U.S. Court of Appeals for the Sixth Circuit (6th Cir.) ruled in an opinion issued on Friday, November 9.  The ruling overturned the district court's dismissal of the EEOC's lawsuit against Cintas Corporation, reversed significant procedural rulings, and found "no basis" for awarding Cintas attorney fees.

EEOC Wins Summary Judgment on Liability in Baltimore County Pension Case

A federal judge has granted summary judgment against Baltimore County in favor of the U.S. Equal Employment Opportunity Commission (EEOC), the federal agency announced today.  In so doing, the judge found that Baltimore County's pension plan, known as the Employee Retirement System (ERS), violates the Age Discrimination in Employment Act (ADEA) because the plan is inherently discriminatory.  U.S. District Judge Benson Everett Legg also denied Baltimore County's motion for summary judgment.

Court Orders AA Foundries to Take Extensive Measures to Prevent Racial Harassment

A federal judge has ordered AA Foundries, Inc., a local San Antonio manufacturer of ferrous castings and producer of foundry mold machines, to implement extensive measures to prevent racial harassment, the U.S. Equal Employment Opportunity Commission (EEOC) announced today.  The EEOC had charged in the underlying lawsuit that African-American employees at AA Foundries routinely experienced racially offensive treatment.  The order follows a jury award of $200,000 in punitive damages to three former employees of AA Foundries.

JEC Enterprises, Inc., which operates at least four McDonald's restaurants in Albuquerque, violated federal law by subject­ing a group of female employees, including teens, to sexual harassment and forcing some women to resign, the U.S. Equal Employment Opportunity Commission (EEOC) charged in a lawsuit it filed September 28th.

Performance Drilling to Pay $28,000 to Settle Race Discrimination Lawsuit with EEOC

The U.S. Equal Employment Opportunity Commission announced today that it settled, for $28,000 and other relief, a race discrimination lawsuit against Performance Drilling Company LLC. Brandon, Miss.-based Performance Drilling provides land drilling services for natural gas and oil exploration and production companies in Mississippi, Alabama, Arkansas, Louisiana, Florida and East Texas. Prior to settlement, Performance Drilling filed for Chapter 11 bankruptcy.

Schindler Elevator Corporation, one of the leading global manufacturers, installers, and servicers of elevators, escalators and moving walkways, discriminated against a black elevator mechanic when it fired him because of his race, the U.S. Equal Employment Opportunity Commission (EEOC) charged in a lawsuit it filed today.  The company maintains it headquarters in Morristown, N.J.

Intellectually Disabled Workers Awarded $1.3M for Pay Discrimination by Henry’s Turkey Service

Hill Country Farms Inc., doing business as Henry’s Turkey Service, violated the Americans with Disabilities Act (ADA) by paying 32 workers with intellectual disabilities severely substandard wages, a judge has ruled in a lawsuit filed by the U.S. Equal Employment Opportunity Commission (EEOC).  The court ordered the company, based in Goldthwaite, Texas, to pay its former employees lawful wages totaling $1.3 million for jobs they performed under contract at a turkey processing plant in West Liberty, Iowa between 2007 and 2009.

Leona's Pizzeria, Inc. has refused to abide by the terms of a conciliation agreement reached with the U.S. Equal Employment Opportunity Commission (EEOC) to resolve a class-wide sexual harassment finding, according to a lawsuit filed by the federal agency in court today.

Seventh Circuit Revives EEOC Disability Discrimination Lawsuit

The U.S. Court of Appeals for the Seventh Circuit reversed the dismissal of a disability discrimination lawsuit filed by the U.S. Equal Employment Opportunity Commission (EEOC) against airline giant United Airlines Inc. The circuit court overturned precedent to agree with the EEOC that "reasonable accommodation" as defined by the Americans with Disabilities Act (ADA) may require employers to provide employees with disabilities with "reassignment to a vacant position" when the employee cannot be accommodated in his or her current position.

EEOC Issues Notice of Proposed Rulemaking to Modify FOIA Regulations

The U.S. Equal Employment Opportunity Commission (EEOC) today issued a Notice of Proposed Rulemaking (NPRM) which would modify certain aspects of the EEOC's Freedom of Information Act (FOIA) regulations.  The NPRM was posted for public inspection today and will be published in the Federal Register on September 4, 2012.  Members of the public wishing to comment on the NPRM will have 60 days from the date of publication to do so.

Magnetics International to Pay $30,000  To Settle EEOC Religious Discrimination Suit

Magnetics International, Inc., a Pennsylvania corporation that supports steel mills by regenerating hydrochloric acid used in the steelmaking process and generates iron oxide as a marketable byproduct, will pay $30,000 to settle a religious discrimination lawsuit brought by the U.S. Equal Employment Opportunity Commission (EEOC), the agency announced today.
