EEOC Files Suit Against Two Employers for Use of Criminal Background Checks

A BMW manufacturing facility in South Carolina, and the largest small-box discount retailer in the United States violated Title VII of the Civil Rights Act by implementing and utilizing a criminal background policy that resulted in employees being fired and others being screened out for employment, the U.S. Equal Employment Opportunity Commission alleged in two lawsuits filed today.

U.S. Supreme Court Denies United Airlines Petition

In a closely watched case, the U.S. Supreme Court issued a written order denying air transportation giant United Airlines's petition for high court review of a disability discrimination lawsuit brought by the U.S. Equal Employment Opportunity Commission (EEOC).  This means the Seventh Circuit Court of Appeal's Sept. 7, 2012 decision will stand, holding that "reasonable accommodation" under the Americans with Disabilities Act (ADA) may require employers to provide employees with disabilities with "reassignment to a vacant position" when the employee cannot be accommodated in his or her current position.  (EEOC v. EEOC  Birmingham Office Signs Memorandum of Understanding with Mexican Consulate

The Birmingham District Office of the U.S. Equal Employment Opportunity Commission (EEOC) will sign a Memorandum of Understanding (MOU) with the Consulate of Mexico in Atlanta on April 17.  The agreement establishes an ongoing collaborative relationship between these two entities to provide Mexican nationals with information, guidance, and access to resources on the prevention of discrimination in the workplace, regardless of documentation status.  Ricardo Camara Sánchez, Consul General of Mexico in Atlanta, and Delner Franklin-Thomas, director of the Birmingham District, will sign the agreement.

Voss Electric Co., doing business as Voss Lighting, will pay $82,500 and furnish company-wide injunctive relief to settle a religious discrimination lawsuit filed by the U.S. Equal Employment Opportunity Commission (EEOC), the agency announced today.  The EEOC had charged that the Lincoln, Neb.-based supplier of replacement lighting products violated federal law by refusing to hire a qualified applicant at its Tulsa location because of his religious beliefs.

Leading Senior Assisted Living Company Settles Religious Discrimination Suit with EEOC

Texas – Senior Living Properties, LLC, which owns 35 senior assisted living facilities in Texas, will pay $42,500 and furnish extensive injunctive relief to settle a religious discrimination lawsuit by the U.S. Equal Employment Opportunity Commission (EEOC), the agency announced today.  The EEOC had charged the company with denying a religious accommodation to an employee.
