A Nashville-based home health care provider discharged a black administrator because of his race in violation of federal law, the U.S. Equal Employment Opportunity Commission (EEOC) charged in a lawsuit it filed today.  The EEOC also charged that the company failed to file EEO-1 reports on its workforce as required by federal law.

Background Screening Company Adopts Revised Procedures in Cooperation with EEOC

The U.S. Equal Employment Opportunity Commission (EEOC) and The Cole Group have reached an agreement reflecting the job applicant screening company's implementation of revised policies and practices to ensure that its pre-employment screenings comply with the Americans with Disabilities Act of 1990 (ADA), the Genetic Nondiscrimination Act of 2008 (GINA), and the anti-retaliation provisions of the federal civil rights laws enforced by the EEOC. The Cole Group screens applicants for hundreds of companies nationwide.

Brookdale Senior Living Communities Sued by EEOC for Disability Discrimination and Retaliation

Brookdale Senior Living Communities, Inc., a Delaware corporation based in Brentwood, Tenn., violated the Americans With Disabilities Act (ADA) in 2012 by failing to provide reasonable accommodations to Bernadine Adams, then the Health & Wellness Director of Brookdale's Heritage Club Mountain View facility in Denver, Colo., the U.S. Equal Employment Opportunity Commission (EEOC) charged in a lawsuit filed September 24. The EEOC also alleged Brookdale further violated the ADA by retaliating against Adams by firing her for requesting a reasonable accommodation for her disability and for filing a charge of discrimination with the agency.

Judge Backs EEOC's Right to Investigate Companywide Policy

A federal court has ordered KB Staffing, Inc., a staffing firm servicing central Florida, to comply with an administrative subpoena issued by the U.S. Equal Employ­ment Opportunity Commission (EEOC), the agency announced today.  The subpoena, issued in December 2013, seeks informa­tion pertaining to a charge filed with the agency alleging that KB Staffing discriminated against current and prospective applicants for employment and/or employees because of improper health questionnaires.

EEOC Sues Taprite Fassco for Sex and Disability Discrimination and Retaliation

Taprite Fassco Manufacturing, Inc., a San Antonio-based supplier of CO2 regulators in the soda and beer industries, violated several federal anti-discrimination laws in its treatment of one of its quality control inspectors, the U.S. Equal Employment Opportunity Commission (EEOC) charged in a lawsuit it filed today.  The EEOC said the company subjected the woman to gender and disability discrimination and unlawfully retaliated against her for complaining.

Judge Approves $2.4 Million EEOC Settlement with Four Hawaii Farms for over 500 Thai Farmworkers

U.S. District Judge Leslie E. Kobayashi in Hawaii has approved settlements between the U.S. Equal Employment Opportunity Commission (EEOC) and four Hawaii farms totaling $2.4 million for about 500 Thai farmworker victims of national origin discrimination and retaliation, the EEOC announced today.  The settlement encompasses monetary relief, options for jobs and benefits, housing, other reimbursements of expenses, and sweeping injunctive relief remedies. The four farms are Mac Farms of Hawaii, LLC [nka MF Nut Co., LLC]; Kauai Coffee Company, Inc., [nka McBryde Resources, Inc.]; Kelena Farms, Inc. and Captain Cook Coffee Company, Ltd.

Supermarket chain Food Lion, LLC violated federal law when it refused to provide a religious accommodation for and then fired an employee who is a Jehovah's Witness, the U.S. Equal Employment Opportunity Commission (EEOC) charged in a workplace discrimination lawsuit it filed today.
