EEOC Issues Final Rules on Employer Wellness Programs

The U.S. Equal Employment Opportunity Commission (EEOC) today issued final rules that describe how Title I of the Americans with Disabilities Act (ADA) and Title II of the Genetic Information Nondiscrimination Act (GINA) apply to wellness programs offered by employers that request health information from employees and their spouses. The two rules provide guidance to both employers and employees about how workplace wellness programs can comply with the ADA and GINA consistent with provisions governing wellness programs in the Health Insurance Portability and Accountability Act, as amended by the Affordable Care Act (Affordable Care Act).

Court Enters Permanent Injunction against BNSF Railway In EEOC Disability Lawsuit

A Washington federal court ordered Texas-based BNSF Railway Co. to pay $95,000 to a qualified applicant denied hire because of an old back injury and also awarded permanent injunctive relief, the U.S. Equal Employment Opportunity Commission (EEOC) announced today. The judgment follows an earlier win by EEOC when the court found the railroad giant liable for disability discrimination without the need for a trial.

EEOC Files First Suits Challenging Sexual Orientation Discrimination as Sex Discrimination

The U.S. Equal Employment Opportunity Commission (EEOC) announced today that it has filed its first two sex discrimination cases based on sexual orientation. The federal agency's Philadelphia District Office filed suit in U.S. District Court for the Western District of Pennsylvania against Scott Medical Health Center, and, in a separate suit, in U.S. District Court for the District of Maryland, Baltimore Division, against Pallet Companies, dba IFCO Systems NA.

EEOC Announces Proposed Addition of Pay Data to Annual EEO-1 Reports

The U.S. Equal Employment Opportunity Commission (EEOC) today made public a proposed revision to the Employer Information Report (EEO-1) to include collecting pay data from employers, including federal contractors, with  100 or more employees. This new data will assist the agency in identifying possible pay discrimination and assist employers in promoting equal pay in their workplaces. The revised EEO-1 will be announced today in conjunction with the White House commemoration of the seventh anniversary of the Lilly Ledbetter Fair Pay Act.

EEOC, Ecuador Sign Partnership Agreement

The U.S. Equal Employment Opportunity Commission (EEOC) and the Republic of Ecuador today committed to work together to combat employment discrimination. In a ceremony at EEOC's Washington, D.C. headquarters, EEOC Chair Jenny R. Yang and Ecuadorian Ambassador Francisco Borja Cevallos signed a national Memorandum of Understanding (MOU) creating a partnership between local consulates and EEOC field offices nationwide.

EEOC Issues Proposed Rule to Amend Title II of GINA

On Friday, October 30, 2015, the U.S. Equal Employment Opportunity Commission (EEOC) will issue a Notice of Proposed Rulemaking (NPRM) to amend the regulations implementing Title II of the Genetic Information Nondiscrimination Act (GINA) as they relate to employer wellness programs that are part of group health plans. The proposed rule would allow employers who offer wellness programs as part of group health plans to provide limited financial and other inducements (also called incentives) in exchange for an employee's spouse providing information about his or her current or past health status. EEOC will accept comments on the proposed rule through Tuesday, December 29, 2015.

M.A. Jones, Inc., a Gilroy-based janitorial contractor, doing business as Cleaning Services, violated federal law by allowing a supervisor to sexually harass a Latina employee and then firing her for opposing his conduct, according to a discrimination lawsuit filed by the U.S. Equal Employment Opportunity Commission (EEOC) today.

The U.S. Equal Employment Opportunity Commission (EEOC) announced today that it has filed suit against Your Health Team, L.L.C. for violating federal law by firing a female home health aide because of her pregnancy. Your Health Team is a home health agency that provides nursing and home health care in the Dallas/Fort Worth area.

EEO-1 Survey for 2015 Now Open

The U.S. Equal Employment Opportunity Commission (EEOC) has completed its mailing of the 2015 EEO-1 survey notification letters, the federal agency announced today. The EEO-1 is an annual survey required to be filed by all private employers with 100 or more employees and federal government contractors or first-tier subcontractors with 50 or more employees and a contract/subcontract of $50,000 or more. The filing of the EEO-1 report is not voluntary, and is required by federal law.   The filing deadline is Sept. 30, 2015.

Bedford Weaving Sued for Genetic Information and Disability Discrimination

Bedford Weaving, Inc., a broad loom fabric weaving manufacturer, violated federal law when it asked an applicant for genetic information and made illegal medical inquiries, the U.S. Equal Employment Opportunity Commission (EEOC) charged in a lawsuit it filed today. The suit also alleged Bedford Weaving failed to hire the applicant because she disclosed her disability on the application and that it failed to retain employment applications as required by federal law.
