Two Texas Energy Corporations Sued By The EEOC For Disability Discrimination

Twenty years after the Americans With Disabilities Act ("ADA") was enacted, the Houston District Office of the U.S. Equal Employment Opportunity Commission (EEOC) has filed two separate lawsuits to enforce the ADA, demonstrating the on-going relevance of and need for the law in today's workplace. The ADA prohibits discrimination against employees and employment applicants with disabilities, including those who are regarded as disabled by their employers, and those who associate with persons who are disabled.

KobeWieland Copper Sued for Disability Discrimination

The U.S. Equal Employment Opportunity Commission (EEOC) today announced it has filed a disability discrimination lawsuit against KobeWieland Copper Products, LLC (KobeWieland) for failing to hire an individual because of his perceived disability at its facility in Pine Hall, North Carolina.  KobeWieland manufactures and sells copper tubing, and employs over 500 associates between its two plants in Pine Hall, NC and Wheeling, IL.

Princeton HealthCare System, which operates a hospital and provides other health care services, violated federal law by failing to reasonably accommodate the needs of its employees who needed medical leave, and then firing them because of their disabilities, the U.S. Equal Employment Opportunity Commission (EEOC) charged in a lawsuit it filed today.

Appeal Settled on EEOC Disability Discrimination Suit Against 7-Eleven

7-Eleven of Hawaii will pay $10,000 and furnish other relief to settle an appeal and underlying federal disability discrimination lawsuit, the U.S. Equal Employment Opportunity Commission (EEOC) announced today.  The EEOC had charged that 7-Eleven failed to keep a former employee's medical information confidential by disclosing the information to a prospective employer, which is a violation of the Americans With Disabilities Act (ADA), and which caused the prospective employer to rescind a job offer.

Arkansas Baptist College Sued By EEOC For Retaliation

Arkansas Baptist College (ABC) in Little Rock, Ark., violated federal law by prematurely canceling an employee's consulting contract and then refusing to allow her to teach classes because she had filed a discrimination charge, the U.S. Equal Employment Opportunity Commission (EEOC) charged in a lawsuit it filed on July 26, 2010.  The employee's previous charge alleged discriminatory demotion.

EEOC Releases Federal Work Force Report

The U.S. Equal Employment Opportunity Commission (EEOC) today released its Annual Report on the Federal Work Force for Fiscal Year (FY) 2009.  The full text of the report is available on the agency's web site at www.eeoc.gov.  The report assesses the state of equal employment opportunity throughout the federal work force – including trends in the composition of the workforce, and data concerning complaints of employment discrimination in the federal sector – and includes practical tips for agencies to improve their performance.

Health Delivery, Inc. To Pay $45,000 To Settle EEOC Disability Discrimination Suit

A Saginaw, Mich.-based health services provider will pay $45,000 and furnish other relief to settle a disability discrimination lawsuit brought by U.S. Equal Employ­ment Opportunity Commission (EEOC), the agency announced today. The EEOC had charged that Health Delivery, Inc. unlawfully refused to return to work an employee with a record of depression even though she had completed a course of treatment and had been approved to return to work.

EEOC Celebrates Its 45th Anniversary

July 2, 2010, marks the 45th anniversary of the U.S. Equal Employment Opportunity Commission (EEOC). Created by the historic Civil Rights Act of 1964, the EEOC was founded to enforce Title VII of that Act, which prohibits discrimination in employment on the basis of race, color, religion, sex or national origin. On July 22, 2010 the EEOC will also celebrate the 20th anniversary of the passage of the Americans with Disabilities Act (ADA), which expanded employment opportunities for physically, emotionally and mentally disabled people.

Pet store giant PETCO Animal Supplies Stores, Inc. will pay $145,000 and furnish other relief to settle a disability discrimination lawsuit filed by the U.S. Equal Employment Opportunity Commission (EEOC), the agency announced today. The EEOC had charged the company with failing to accommodate a deaf pet groomer formerly employed at one of its stores in Aurora, Colo.

EEOC Sues FAPS, Inc. For Discriminatory Hiring Practices

The U.S. Equal Employment Opportunity Commission (EEOC) filed a workplace discrimination suit today against FAPS, Inc., an automotive port processor, charging that the company has engaged in an ongoing pattern or practice of race discrimination against African-Americans in recruitment and hiring. The suit also charges that FAPS has made improper pre-employment disability-related inquiries of applicants. Both these alleged practices violate federal law.

Denver Cabinet and Appliance Retailer Sued by EEOC for Disability Discrimination

The U.S. Equal Employment Opportunity Commission (EEOC) charged in a lawsuit filed earlier this week that Discount Cabinets and Appliances, a Denver-based retail company, violated the Americans With Disabilities Act (ADA) when it denied a hearing-impaired warehouse assistant's request that the company provide a telephone with volume control, and shortly thereafter fired him because of his disability.
