Fifth Circuit Rules for the EEOC in Age and Disability Discrimination Lawsuit

In a unanimous decision issued on Friday, July 26, 2013, the U. S. Court of Appeals for the Fifth Circuit reversed a Beaumont, Texas, trial court judge's grant of summary judgment in favor of DynMcDermott Petroleum Operations Company (DM), a federal contractor, the U.S. Equal Employment Opportunity Commission (EEOC) announced.  The EEOC had sued the company, alleging that it discriminated against an applicant on the basis of age and disability.

$100,000 Consent Decree Ends Disabilities Act Lawsuit Against Giant Staffing Agency

Staffmark Investment LLC, one of the nation's largest commercial staffing companies, will pay $100,000 under a consent decree entered June 25, 2013 which ended a disability discrimination lawsuit brought by the U.S. Equal Employment Opportunity Commission (EEOC).  The EEOC alleged that Staffmark violated the Americans with Disabilities Act (ADA) when it terminated a woman with a prosthetic leg because of her disability.

Chipotle Mexican Grill, Inc., a Colorado-based nationwide restaurant chain, violated federal law when it fired an employee because of her cystic fibrosis and its treatment, the U.S. Equal Employment Opportunity Commission (EEOC) charged in a lawsuit it filed today.  The EEOC said Chipotle subjected Amanda Connell to disability discrimination at its Franklin, Mass., location the day after she arrived at work with a shunt in her arm for the intravenous treatment of cystic fibrosis.

Federal Court Allows EEOC Disability Case to Proceed, Denying United Parcel Service's Appeal

A federal district court has denied United Parcel Service's (UPS) motion to appeal an earlier ruling in favor of the U.S. Equal Employment Opportunity Commission (EEOC), the agency announced today.  The contested ruling allowed the Commission's disability discrimination case to proceed to the discovery phase.  (EEOC, et al., v. CSI Corporation of DC will pay $12,000 to resolve an EEOC lawsuit alleging pregnancy discrimination, unlawful medical inquiries and retaliation, the U.S. Equal Employment Opportunity Commission announced today.  This is in addition to the $30,000 already paid by Trinity Protection Services, Inc. to resolve its part of the lawsuit. U.S. Supreme Court Denies United Airlines Petition

In a closely watched case, the U.S. Supreme Court issued a written order denying air transportation giant United Airlines's petition for high court review of a disability discrimination lawsuit brought by the U.S. Equal Employment Opportunity Commission (EEOC).  This means the Seventh Circuit Court of Appeal's Sept. 7, 2012 decision will stand, holding that "reasonable accommodation" under the Americans with Disabilities Act (ADA) may require employers to provide employees with disabilities with "reassignment to a vacant position" when the employee cannot be accommodated in his or her current position.  (EEOC v. United Airlines, 1:10-CV-01699, U.S. Dist. Court, No. Dist. of Illinois; EEOC v. United Airlines, No. 11-1774. 7th Cir.)
