EEOC Issues Final Rules on Employer Wellness Programs

The U.S. Equal Employment Opportunity Commission (EEOC) today issued final rules that describe how Title I of the Americans with Disabilities Act (ADA) and Title II of the Genetic Information Nondiscrimination Act (GINA) apply to wellness programs offered by employers that request health information from employees and their spouses. The two rules provide guidance to both employers and employees about how workplace wellness programs can comply with the ADA and GINA consistent with provisions governing wellness programs in the Health Insurance Portability and Accountability Act, as amended by the Affordable Care Act (Affordable Care Act).

Lowe's to Pay $8.6 Million to Settle EEOC Disability Discrimination Suit

The U.S. Equal Employment Opportunity Commission (EEOC) today announced the approval of the resolution of a nationwide disability discrimination case against home improvement, appliance and hardware giant Lowe's. U.S. District Court Judge André Birotte Jr. approved the consent decree which calls for the distribution of $8.6 million.

Grisham Farm Products, Inc. of Mountain Grove, Mo., violated federal law by requiring all job applicants to fill out a three-page health history before they would be considered for a job, the U.S. Equal Employment Opportunity Commission (EEOC) charged in a lawsuit it filed today. EEOC also alleged Grisham Farm Products does not maintain or retain employment records and applications for employment, as required by law.

Court Enters Permanent Injunction against BNSF Railway In EEOC Disability Lawsuit

A Washington federal court ordered Texas-based BNSF Railway Co. to pay $95,000 to a qualified applicant denied hire because of an old back injury and also awarded permanent injunctive relief, the U.S. Equal Employment Opportunity Commission (EEOC) announced today. The judgment follows an earlier win by EEOC when the court found the railroad giant liable for disability discrimination without the need for a trial.

The U.S. Equal Employment Opportunity Commission (EEOC), Office of Federal Operations (OFO), today announced the issuance of the 2016 Federal Training Course Calendar, which includes two new courses: Special Emphasis Program Manager and Unlawful Harassment: An Agency Responsibility.
