EEOC Issues Final Rule on "Reasonable Factors Other than Age" Under the ADEA

The U.S. Equal Employment Opportunity Commission (EEOC) today issued the "Final Regulation on Disparate Impact and Reasonable Factors Other than Age" (RFOA)  under the Age Discrimination in Employment Act of 1967 (ADEA). The final rule was coordinated with other federal agencies and reviewed by the Office of Management and Budget (OMB).  The rule was posted for public inspection today and will be published in the Federal Register on Friday, March 30.

Brooks County, Texas Settles EEOC Retaliation Discrimination Suit

Brooks County, Texas will pay $20,000 and furnish other relief to settle an employment discrimination lawsuit filed by the U.S. Equal Employment Opportunity Commission, (EEOC), the agency announced today.  The EEOC had charged that the county government unlawfully retaliated against an employee for filing an age discrimination complaint.

Unlawful Discrimination Based on Pregnancy and Caregiving Responsibilities Widespread Problem, Panelists Tell EEOC

At a time when most pregnant women want and need to work, and more American workers struggle to balance work and family, discrimination against pregnant women and workers with caregiving responsibilities remains a significant problem, experts told the U.S. Equal Employment Opportunity Commission at a public meeting today.  The meeting follows up on Commission meetings in 2007, when the Commission issued its groundbreaking "Enforcement Guidance on Unlawful Disparate Treatment of Workers with Caregiving Responsibilities" and in 2009 when the Commission issued "Employer Best Practices for Workers with Caregiving Responsibilities."

A large Auburn Hills, Mich.-based manufacturer of parts for the automotive, aerospace, defense, and marine industries violated federal law by laying off various engineers on the basis of their age, the U.S. Equal Employment Opportunity Commission (EEOC) charged in a lawsuit it filed today.

Bank of Albuquerque Discriminated on the Basis of Age and Sex, EEOC Alleges in Lawsuit

BOK Financial Corporation, doing business as the Bank of Albuquerque, unlawfully discharged managers Elizabeth Morantes and Yolanda Fernandez because they were women over 40 years of age, the U.S. Equal Employment Opportunity Commission (EEOC) alleged in a lawsuit filed today. The EEOC's lawsuit also alleges that another employee, Betty Brewer, was disciplined because of her sex and age.

EEOC Launches Small Business Task Force

The U.S. Equal Employment Opportunity Commission (EEOC) today launched an internal task force that will focus on expanding and improving outreach and technical assistance to small businesses. The Small Business Task Force, led by Commissioner Constance S. Barker, will work to find ways in which the agency could better collaborate with the small business community to ensure compliance with federal anti-discrimination laws.

Butterball Sued By EEOC For Harassment, Firing Of HIV-Positive Employee

The U.S. Equal Employment Opportunity Commission (EEOC) charged in a lawsuit filed today that Butterball, LLC, a Garner, N.C.-based turkey processing company, violated federal law by subjecting an employee to a hostile work environment based on the fact that she has Human Immunodeficiency Virus (HIV), and firing her because of that disability.

Sears, Roebuck & Co., one of the nation's largest retailers, will pay $100,000 and furnish other relief to settle a race, sex and age discrimination and retaliation lawsuit filed by the U.S. Equal Employment Opportunity Commission (EEOC), the agency announced today. The EEOC had charged that Sears subjected an African-American female employee over the age of 40 to race, age and sex discrimination as well as retaliation for complaining about it.

Fire Mountain Restaurants / Ryan's Family Steakhouse Sued by EEOC for Age Discrimination

The U.S. Equal Employment Opportunity Commission (EEOC) today announced it has filed an age discrimination lawsuit against Fire Mountain Restaurants, LLC, doing business as Ryan's Family Steakhouse.  The lawsuit charged that Ryan's discriminated against Viola Brown when it reduced her hours, disciplined and suspended her, and finally fired her because of her age, then 79, and in retaliation for her complaints about age discrimination.

Town of Clarence and Western New York Fire Companies Settle EEOC Age Discrimination Suit

The Town of Clarence, N.Y., and the Clarence, Harris Hill, East Amherst and Swormville Fire Protection Districts and Volunteer Fire Companies will pay $441,740 to settle a class age discrimination lawsuit brought by the U.S. Equal Employment Opportunity Commission (EEOC), the agency announced today.  The damages will be made in retroactive payments to a group of 35 firefighters, including the beneficiaries for eight deceased firefighters who had been discriminated against based on their age.  Several firefighters will also receive increased monthly pension amounts going forward.
