Jocelyn Samuels Sworn in as EEOC Commissioner

JOCELYN SAMUELS SWORN IN AS EEOC COMMISSIONER

WASHINGTON – Jocelyn Samuels was sworn in today as Commissioner of the U.S. Equal Employment Opportunity Commission (EEOC), the agency announced this morning.  Samuels was nominated by President Trump on March 16, 2020, and was confirmed on September 23, 2020, to serve as Commissioner, for a term expiring July 1, 2021.

Samuels joins Chair Janet Dhillon, Vice Chair Keith Sonderling and Commissioner Charlotte Burrows on the presidentially appointed bipartisan Commission.

EEOC Issues Final Rule Revising Procedural Regulations Under Title VII, ADA, and GINA

WASHINGTON – The U.S. Equal Employment Opportunity Commission (EEOC) today issued a final rule that amends its procedural regulations to explicitly provide for digital transmissions of documents and to update no cause determination procedures.  This final rule was posted by the Federal Register for public inspection today and will be published in the Federal Register on October 15, 2020.

EEOC Sues USF Holland for Sex Discrimination

MEMPHIS, Tenn. – USF Holland, LLC, a trucking company providing transportation and delivery services to customers throughout North America, violated federal law when it refused for decades to hire qualified females for truck driving positions because of their sex, the U.S. Equal Employment Opportunity Commission (EEOC) charged in a lawsuit filed today.

USF Holland operates over 50 terminals in the United States. The EEOC alleges the discrim­ination occurred at Holland’s Olive Branch, Miss., terminal.

Dillard’s to Pay $900,000 to Resolve EEOC Race Discrimination Lawsuit

LITTLE ROCK, Ark. – Department store chain Dillard’s, Inc. will pay $900,000, revise itsjobposting process, and furnish other relief to settle an EEOC lawsuit charging failure to promote African American employees based on race, the federal agency announced today.

According to EEOC’s lawsuit, Dillard’s, which is headquartered in Little Rock, failed to post supervisory and management positions at its retail locations nationwide and failed to promote African American employees into those positions.

EEOC Requests Public Comment on Changes to Conciliation Process

WASHINGTON –The Federal Register today published the U.S. Equal Employment Opportunity Commission’s (EEOC) Notice of Proposed Rulemaking (NPRM) on conciliation.  The EEOC is proposing to amend its procedural rules in order to enhance the effectiveness and accountability of the conciliation process.  The public now has 30 days to provide comments on the NPRM.

Oceanic Time Warner Cable, Charter Communications, Inc. to Settle EEOC Disability Lawsuit

HONOLULU, Hawaii – Oceanic Time Warner Cable LLC and Charter Communications, Inc. (Oceanic) agree to pay $800,000 and provide other injunctive relief to settle a disability discrimination lawsuit filed by the U.S. Equal Employment Opportunity Commission (EEOC), the agency announced today.

Thompson Construction Group to Pay $115,000 to Settle EEOC Race Discrimination Lawsuit

RALEIGH, N.C. – Thompson Construction Group, Inc., a heavy industrial contractor based in Sumter, S.C., will pay $115,000 and provide other relief to settle a race dis­crimination lawsuit filed by the U.S. Equal Employment Opportunity Commission (EEOC), the federal agency announced today.

EEOC Sues Scottsdale Healthcare Hospitals / Honorhealth for Disability Discrimination

SCOTTSDALE, Ariz. – Scottsdale Healthcare Hospitals, doing business as HonorHealth, which provides medical care at a number of hospitals and medical facilities in the Phoenix area, failed to provide reasonable accommodations to employees with disabilities, the U.S. Equal Employment Opportunity Commission charged in a lawsuit filed on Tuesday.
