Targeted Disabilities

As of September 30, 2008, NLRB employed 12 (0.73%) Individuals with Targeted Disabilities (IWTD). In order to have met the federal 2% participation rate goal, 33 IWTD were needed. This is the same as the number of employees in FY 2007 and a decrease of 3 employees since FY 2004. The participation rate for FY 2007 was 0.7% and for FY 2004 was 0.79%. Over the 5-year period NLRB had a net decrease of 0.06% in employees with targeted disabilities.

EEO Complaint Processing

I. Counseling

NLRB timely processed 89.5% of the 19 pre-complaint counselings (without remands) completed in FY 2008.

II. Bases of Complaints Filed

The bases of alleged discrimination most often raised were: (1) Race (Black/African American); (2) Reprisal; and (3) Sex (Male). Of the 9 complaints filed at NLRB, 5 contained allegations of race (Black/African American) discrimination, 1 contained an allegation of color discrimination and 2 contained allegations of disability discrimination.

III. Complaint Processing Times

Of the 8 completed investigations, 87.5% were timely. NLRB's average time for completing an investigation was 208 days. Of the agencies completing 25 or more investigations, the U.S. Postal Service had the lowest average of 103 days.

NLRB's average processing time for all complaint closures decreased from 366 days in FY 2007 to 348 days in FY 2008. The government-wide average was 336 days.

IV. Costs

NLRB reported paying no monetary benefits for 4 pre-complaint settlements. NLRB expended a total of $45,634 for 8 complaint investigations, for an average expenditure of $5,704.

NLRB agreed to pay a total of $6,500 plus other benefits for 7 complaint closures through settlement agreements, final agency decisions, and final agency orders fully implementing AJ decisions. For the 3 complaint closures with monetary benefits, the average award was $2,167.
