As of September 30, 2008, DOT employed 315 (0.57%) Individuals with Targeted Disabilities (IWTD). In order to have met the federal 2% participation rate goal, 1,108 IWTD were needed. This represented an increase of 13 employees over FY 2007 and a decrease of 7 employees since FY 2004. The participation rate for FY 2007 was 0.56% and for FY 2004 was 0.56%. Over the 5-year period DOT had a net increase of 0.01% in employees with targeted disabilities.
I. Counseling
DOT timely processed 94.4% of the 625 pre-complaint counselings (without remands) completed in FY 2008.
II. Bases of Complaints Filed
Of the 346 completed investigations, 56.6% were timely. DOT's average time for completing an investigation was 236 days. Of the agencies completing 25 or more investigations, the U.S. Postal Service had the lowest average of 103 days.
DOT's average processing time for all complaint closures increased from 321 days in FY 2007 to 423 days in FY 2008. The government-wide average was 336 days.
III. Complaint Processing Times
Of the 300 completed investigations, 79.3% were timely. DOT's average time for completing an investigation was 194 days. Of the agencies completing 25 or more investigations, the Tennessee Valley Authority had the lowest average of 93 days.
DOT's average processing time for all complaint closures increased from 285 days in FY 2006 to 321 days in FY 2008. The government-wide average was 355 days.
IV. Costs
DOT agreed to pay $30,678 for 39 pre-complaint settlements, of which 4 were monetary settlements averaging $7,669. DOT expended a total of $1,637,128 for 346 complaint investigations, for an average expenditure of $4,731.
DOT agreed to pay a total of $1,222,427 plus other benefits for 94 complaint closures through settlement agreements, final agency decisions, and final agency orders fully implementing AJ decisions. For the 40 complaint closures with monetary benefits, the average award was $30,561.
