As of September 30, 2008, DOJ employed 408 (0.38%) Individuals with Targeted Disabilities (IWTD). In order to have met the federal 2% participation rate goal, 2,167 IWTD were needed. This represented a decrease of 4 employees from FY 2007 and an increase of 2 employees since FY 2004. The participation rate for FY 2007 was 0.39% and for FY 2004 was 0.39%. Over the 5-year period DOJ had a net decrease of 0.01% in employees with targeted disabilities.
I. Counseling
DOJ timely processed 85.4% of the 1,408 pre-complaint counselings (without remands) completed in FY 2008.
II. Bases of Complaints Filed
The bases of alleged discrimination most often raised were: (1) Reprisal; (2) Sex (Female); and (3) Age. Of the 687 complaints filed at DOJ, 163 contained allegations of race (Black/African American) discrimination, 83 contained allegations of race (White) discrimination, 11 contained allegations of race (Asian) discrimination, 7 contained allegations of race (American Indian/Alaska Native) discrimination, 16 contained allegations of color discrimination and 161 contained allegations of disability discrimination.
III. Complaint Processing Times
Of the 645 completed investigations, 63.4% were timely. DOJ's average time for completing an investigation was 287 days. Of the agencies completing 25 or more investigations, the U.S. Postal Service had the lowest average of 103 days.
DOJ's average processing time for all complaint closures increased from 378 days in FY 2007 to 505 days in FY 2008. The government-wide average was 336 days.
IV. Costs
DOJ agreed to pay $3,500 for 69 pre-complaint settlements, of which 1 were monetary settlements averaging $3,500. DOJ expended a total of $2,717,372 for 645 complaint investigations, for an average expenditure of $4,212.
DOJ agreed to pay a total of $2,114,942 plus other benefits for 98 complaint closures through settlement agreements, final agency decisions, and final agency orders fully implementing AJ decisions. For the 65 complaint closures with monetary benefits, the average award was $32,538.
